These terms govern your use of UltraMarketer, the AI marketing agent available at ultramarketer.com (the "Service"), provided by the administrator of the ultramarketer.com service ("we", "us"). By creating an account or buying a plan you accept these terms, the privacy policy and the refund policy. If you accept on behalf of a company, you confirm you may bind it.
1. The Service
UltraMarketer connects to your website and the accounts you choose, finds marketing opportunities, ranks them by expected impact, prepares assets and executes the actions you approve in your connected accounts. Expected impact figures are estimates based on your data and are not a promise of results. The Service is for business use only.
2. Accounts and seats
You are responsible for the people you invite, the roles you give them and everything done under your workspace. Keep sign-in details private and tell us at once if you suspect unauthorised access. Seats are for named people and may not be shared.
3. Plans, billing and auto-renewal
- Plans are subscriptions billed monthly or yearly in advance, at the price shown at checkout. Yearly plans are paid once for twelve months.
- Your subscription renews automatically at the end of each period until you cancel. The renewal charge for a new period is due when the period starts.
- Plan limits (websites, Weekly Growth Plans, prepared assets, launches, scans, ad accounts, competitors, tests, seats, expert reviews) count use within each billing period. Deleting items does not restore use. Unused amounts do not carry over.
- Moving to a higher plan or a longer period takes effect immediately and the prorated difference is charged at once. Moving to a lower plan or a shorter period takes effect immediately and the unused part of the period is kept as credit on the next invoice; it is not paid out.
- Prices exclude taxes where taxes apply. We may change prices for future periods with at least 30 days' notice by email.
4. Cancelling
You can cancel at any time in the billing portal. Cancelling stops future renewals; you keep access until the end of the period already paid. Payments are final, except as set out in the refund policy.
5. Free website scan
The website scan is offered without charge, may be limited per day, per network and per account, and may be changed or withdrawn at any time. It is not a subscription plan.
6. Connected accounts and your ad spend
- You connect only accounts you are authorised to manage, and you grant the access needed for the features you use. You can revoke access at any time.
- Advertising spend, platform fees and any costs charged by connected platforms are between you and those platforms and are your responsibility. UltraMarketer does not pay or resell media.
- Actions are executed only according to your approval mode. You are responsible for reviewing prepared assets and for the approvals given in your workspace, including actions executed automatically under an autopilot setting you enabled.
- You are responsible for the content of ads, pages and emails you approve and for compliance with the policies of each platform and with advertising, privacy and consumer laws.
7. Guardrails
The Service provides approval modes, spend caps, maximum weekly budget changes, paused starts, an execution log and rollback. These controls reduce risk but depend on the limits you set and on the connected platforms carrying out requests correctly. Check the limits in your workspace settings and monitor your accounts.
8. Acceptable use
You may not use the Service to promote illegal products or services, to send unsolicited messages, to run deceptive or infringing ads, to scan websites you have no right to analyse at scale, to probe or overload our systems or third-party systems, to resell the Service without our written consent, or to reverse engineer it. We may suspend accounts that break these rules.
9. Your data and content
You keep all rights in your data and in the assets prepared for you. You give us a licence to process them only to provide the Service. Prepared assets are generated by AI and should be reviewed before use. Our handling of personal data is described in the privacy policy.
10. Expert reviews
On the Company + Expert plan, review requests are answered in the panel, normally within 1 business day, up to the monthly number in your plan. Expert reviews are advice; decisions and approvals remain yours.
11. Availability and changes
We work to keep the Service available and may change features as it develops, without materially reducing the core features of a paid plan during a paid period. Connected platforms may change their interfaces or policies, which can affect what the Service can read or execute.
12. Disclaimers and liability
The Service is provided as is. To the extent permitted by law, we do not guarantee any particular marketing result, and we are not liable for indirect, incidental or consequential damages, lost profits, lost revenue or advertising spend. Our total liability for any claim is limited to the fees you paid for the Service in the three months before the event giving rise to the claim. Nothing in these terms limits liability that cannot be limited by law.
13. Chargebacks
If you believe a charge is wrong, contact us first as set out in the refund policy. Opening a chargeback without doing so is a breach of these terms and leads to closure of the account.
14. Termination
You may stop using the Service at any time. We may suspend or end access for a material breach of these terms. On termination, access to the workspace ends at the end of the paid period or at once for breach, and you can ask us to delete your data.
15. General
We may update these terms; the date at the top shows the current version and material changes are emailed to account owners at least 14 days before they apply. If a provision is unenforceable, the rest stays in effect. Questions go to support@ultramarketer.com.
